Laws and Regulations Applicable to Enforcement of Foreign Arbitral Award; Time Limit for Commencement of Enforcement (Decision of Albanian Supreme Court, Case No.11242-00075-00-2005 of 21 December 2006)

Rationes Decidendi:

The recognition of a foreign arbitral award has a functional connection with the enforcement thereof. The decision regarding enforcement therefore inherently implies the recognition of the arbitral award.
The limitation (refusal) of the recognition and enforcement of a foreign arbitral award is governed by the laws of the state in which recognition/enforcement is sought, as applicable at the time the arbitral award was issued.
The recognition/enforcement of a foreign arbitral award cannot be granted if the time limit for the commencement of the proceedings for recognition/enforcement has expired under applicable law.
